These Terms & Conditions apply to all estimates, online bookings, service requests, diagnostic visits, invoices, and repair services provided by UTSP LLC. By requesting service, paying the Service Call Fee, approving an estimate, or authorizing repairs, the customer agrees to these Terms.
1. Definitions
“Service Call Fee” means the diagnostic and dispatch fee charged before technician dispatch. “Customer” means the individual or entity requesting service. “Services” include diagnosis, repair, maintenance, installation of replacement parts, and related work performed by UTSP LLC.
2. Payment Terms
Residential customers must pay in full immediately upon completion of the service unless otherwise agreed in writing. Commercial customers may receive alternative payment terms only when approved by UTSP LLC in writing. UTSP LLC reserves the right to suspend future service on delinquent accounts.
3. Service Call Fee
A Service Call Fee is collected before the technician is dispatched. The fee compensates UTSP LLC for scheduling, travel, diagnosis, and technician time. Unless specifically stated otherwise in writing, the Service Call Fee is non-refundable once the technician has been dispatched or diagnostic work has begun. The fee may be credited toward the repair as described in the approved estimate.
4. Payment Authorization
By scheduling service, approving an estimate, or providing a payment method, the Customer authorizes UTSP LLC to charge the payment method on file for the Service Call Fee, completed repairs, approved parts, applicable cancellation charges, no-show charges, returned payment fees, and any other amounts authorized under these Terms.
5. Appointment Scheduling
Appointment windows are estimates only. Arrival times may be affected by traffic, weather, emergency calls, parts availability, or previous jobs. UTSP LLC will make reasonable efforts to notify customers of significant delays.
6. Cancellation & Rescheduling
Cancellations requested more than 24 hours before the scheduled appointment may receive a refund of the Service Call Fee if the technician has not been dispatched and no expenses have been incurred. Appointments cancelled within 24 hours may be subject to forfeiture of the Service Call Fee. If special-order parts have already been purchased, the Customer remains responsible for all non-refundable costs, restocking fees, shipping charges, and expenses already incurred.
7. No-Show & Access
The Customer is responsible for providing safe and timely access to the appliance. If the technician cannot gain access within 15 minutes of arrival, the appointment may be treated as a no-show. A new appointment will require payment of an additional Service Call Fee. UTSP LLC may refuse service where conditions are unsafe or hazardous.
8. Returned Payments & Late Payment
A $35 fee may be charged for returned or declined payments where permitted by law. Overdue balances may accrue interest or late charges as permitted by applicable law. The Customer agrees to pay reasonable collection costs, attorney's fees, and court costs incurred in collecting unpaid balances, where permitted.
9. Customer Responsibilities
The Customer shall provide safe, unobstructed access to the appliance and surrounding work area. Appliances should be emptied when necessary, disconnected from personal security devices, and accessible for inspection. The Customer is responsible for obtaining any landlord, property manager, or HOA approvals required before service.
10. Built-In & Heavy Appliances
UTSP LLC is not responsible for removing cabinetry, countertops, flooring, plumbing, gas piping, electrical wiring, or permanently installed structures to access an appliance. If a built-in appliance cannot be safely removed, service may be declined or rescheduled until proper access is provided.
11. Diagnostic Services
Diagnostic service is intended to identify the most likely cause of the reported failure based on conditions existing during the appointment. Hidden defects, intermittent failures, prior repairs, or additional failed components may not be discovered until repairs begin.
12. Estimates & Additional Repairs
Repair estimates are based on information available at the time of diagnosis. If additional problems are discovered, UTSP LLC will provide a revised estimate before continuing whenever reasonably possible. The Customer is under no obligation to approve additional repairs.
13. Parts Availability
Estimated delivery dates for replacement parts are provided in good faith but are not guaranteed. Manufacturer delays, discontinued parts, shipping delays, or supplier shortages are beyond UTSP LLC's control.
14. Special-Order Parts
Special-order, non-stock, or custom parts are generally non-refundable once ordered. If the Customer cancels after such parts have been ordered, the Customer remains responsible for all non-returnable parts, shipping, and restocking costs.
15. Customer-Supplied Parts
UTSP LLC may, at its discretion, install customer-supplied parts. No warranty is provided on customer-supplied parts, and UTSP LLC is not responsible for incorrect, defective, incompatible, counterfeit, or damaged parts supplied by the Customer.
16. Existing Damage & Hidden Conditions
UTSP LLC is not responsible for pre-existing cosmetic damage, rust, corrosion, cracked plastic, brittle wiring, worn fasteners, previous improper repairs, pest damage, water damage, mold, or any hidden condition discovered during diagnosis or repair. Removal of panels or components may reveal conditions that were not visible before service.
17. Unsafe Conditions
UTSP LLC reserves the right to refuse or discontinue service if conditions are unsafe, including but not limited to gas leaks, exposed live electrical hazards, severe water damage, biohazards, pest infestations, structural instability, or any condition presenting unreasonable risk to technicians.
18. Warranty
Unless otherwise stated in writing, UTSP LLC warrants its labor for the period shown on the invoice. Manufacturer warranties on replacement parts remain the responsibility of the manufacturer. Warranty is void if the appliance is serviced, modified, or disassembled by anyone else, or if damage results from misuse, abuse, power surges, utility interruptions, pest infestation, flooding, fire, improper installation, or unrelated component failures.
19. Food Loss Disclaimer
UTSP LLC is not responsible for spoiled food, medications, or other perishables resulting from appliance failure before, during, or after service, including delays caused by parts availability or manufacturer backorders.
20. Limitation of Liability
To the maximum extent permitted by law, UTSP LLC shall not be liable for incidental, indirect, special, consequential, or punitive damages, including loss of use, lost income, business interruption, or property damage beyond the direct cost of the services provided. Liability shall not exceed the amount paid to UTSP LLC for the specific service giving rise to the claim, except where prohibited by law.
21. Communications
By providing contact information, the Customer consents to receive phone calls, emails, and text messages regarding scheduling, appointment reminders, estimates, invoices, payment requests, warranty matters, and follow-up service. Promotional messages may be declined at any time without affecting essential service communications.
22. Photographs & Documentation
Technicians may photograph appliances, installed parts, serial numbers, model numbers, and work areas for documentation, quality control, warranty administration, insurance claims, training, and dispute resolution. Photographs will not intentionally include unrelated private living areas.
23. Collection Costs
If an account is referred for collection or legal action, the Customer agrees, where permitted by law, to pay reasonable collection costs, court costs, attorney's fees, and any lawful interest on unpaid balances.
24. Governing Law
These Terms & Conditions shall be governed by the laws of the State of Connecticut. Any dispute arising from these Terms or the services provided by UTSP LLC shall be resolved in a court of competent jurisdiction located in Connecticut unless otherwise required by law.
25. Entire Agreement
These Terms & Conditions, together with any approved estimate, invoice, or written service authorization, constitute the entire agreement between UTSP LLC and the Customer and supersede prior oral discussions regarding the services.
26. Acceptance of Terms
By scheduling service, paying the Service Call Fee, approving an estimate, authorizing repairs, or accepting completed work, the Customer acknowledges that they have read, understood, and agree to these Terms & Conditions.
